Can I Sue My Employer for a Slip & Fall Accident?

Transcript: I’m often asked if I can sue my employer if I’ve had an accident on the job and I’ve slipped, tripped, or fallen. Well, the short answer is you cannot sue your employer. But the good news is very often you don’t need to sue your employer, even if you’ve fallen while at work. You may be a delivery man, and maybe you’re delivering packages or goods to a store, and the cause of the accident was a fall on somebody else’s property such as the store owner. In that case, you’re not going to sue your employer, but you’re going to sue the responsible store owner for perhaps having negligent conditions on their property such as grease on the stairs, broken stairs, a broken walkway, a negligent entranceway. So, while you cannot sue your employer under New York state law, very often you don’t need to sue your employer to recover for your injuries.
